Terms of Service

01 Agreement

These Terms of Service ("Terms") form a binding agreement between you and Formcraft Inc. ("Formcraft", "we", "us") for your use of the Formcraft website, form builder, dashboard, integrations and related services (together, the "Service"). By creating an account or using the Service you accept these Terms. If you use the Service on behalf of a business, you confirm that you are authorized to accept these Terms for it.

02 Your account

• You must be at least 16 years old and provide accurate sign-up information.
• You are responsible for keeping your login credentials secure and for all activity under your account.
• Tell us right away at [email protected] if you suspect unauthorized access.
• On Business plans, the account owner controls member access and is responsible for members' use.

03 The service

Formcraft lets you build forms and surveys with a drag-and-drop editor, publish them as a link, embed or QR code, collect and export responses, and optionally accept payments through your own Stripe account. Features available to you depend on your plan, as described on the pricing page.

04 Your forms and your respondents

You are the owner and operator of every form you build on Formcraft. You are responsible for the questions you ask, the lawfulness of collecting that information, and for giving the people who respond to your form ("respondents") any privacy notice or consent that applicable law requires. Formcraft is not a party to the relationship between you and your respondents.

You agree not to build a form that:

• impersonates a person, business or government agency to deceive respondents (phishing);
• asks respondents for account passwords, full card numbers, or other credentials that should never be collected through a form;
• collects special-category data (such as detailed health or biometric records) without a lawful basis and appropriate safeguards.

When respondents submit answers to your form, you act as the controller of their personal data and we process it on your behalf, as described in our Privacy Policy.

05 Plans, billing and taxes

• Paid plans are billed in advance, monthly or yearly, and renew automatically until cancelled.
• Upgrades take effect immediately and are prorated. Downgrades and cancellations take effect at the end of the current period.
• Prices exclude VAT and sales tax, which we add where required.
• We may change prices with at least 30 days' notice by email. Changes apply from your next renewal.
• Payments your respondents make through a payment field are processed by Stripe under Stripe's own terms and paid out to your own Stripe account. Formcraft does not hold or route those funds.
• Refunds of Formcraft subscription fees are covered by our Refund Policy.

06 Acceptable use

You agree not to:

• use the Service for anything unlawful, deceptive or harmful, or to offer illegal goods or services;
• send spam or unsolicited messages through form notifications or confirmation emails;
• upload malware, probe or overload our systems, or bypass usage limits;
• scrape, resell or sublicense the Service without our written permission.

07 Your content and data

You own the content you put into Formcraft, including form questions, design choices and response data. You grant us a limited license to host, copy and display that content only as needed to run the Service. You can export your data at any time from the dashboard.

08 Our intellectual property

The Service, its software, design and the Formcraft name and logo belong to Formcraft Inc.. Formcraft is proprietary software; these Terms grant you a non-exclusive, non-transferable right to use it during your subscription and nothing more. Feedback you send us may be used to improve the product without obligation to you.

09 Availability and changes

We aim for 99.9% monthly uptime and announce planned maintenance in advance. We may add, change or retire features over time. If we remove a feature that is material to a paid plan, we will give you at least 30 days' notice and, if you choose to cancel, a prorated refund.

10 Suspension and termination

You may close your account at any time from settings or by emailing us. We may suspend or terminate accounts that breach these Terms, after notice where reasonably possible. After closure you have 30 days to export your data, after which it is deleted as described in the Privacy Policy.

11 Disclaimers and liability

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We are not liable for indirect, incidental or consequential losses, including lost responses or revenue. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

12 Governing law

These Terms are governed by the laws of the jurisdiction in which Formcraft Inc. is registered, without regard to conflict-of-law rules. If you are a consumer, you keep any mandatory protections of the country where you live.
